The law firm “DE LA CRUZ & ASOCIADOS” emerged in 1995 between the spouses Yanilda De La Cruz and Jose Acosta.

Mrs. Yanilda De La Cruz had just graduated from a law degree and Mr. José Acosta had a degree in accounting and was a computer technician.

Previously, both had worked in one of the most important law offices at that time in the municipality of Sosúa for 5 years.

Our Practice

Payment of Fees

Invoices issued must be paid once received. Unpaid invoices after 30 days from the date of receipt will generate a late payment fee of 2% per month. The firm reserves the right, with prior notice, to terminate the contractual relationship in the event of repeated failure to pay.

Conservation of Hard Copy and Electronic Data

The firm will keep a printed and electronic copy of the documentation of your case for a period of 10 years from its completion. After said term, the firm may proceed to the destruction of the documentation.

Termination of Services

You may terminate our contract at any time by giving us 30 days’ advance notice and paying us the fees and costs incurred, including the ones for dealing with any successor attorney and preparing to deliver the case files. In turn, the firm may terminate the contract at any time, and without the need to claim cause, subject to a prior 30-day notice.

Expenses of Funds

At the time of issuance of the first invoice, the firm may request an advance of the expenses and costs that it will incur in the management of your matter, a request that may be repeated as many times as the advanced funds for this purpose are exhausted. In any case, it is understood that the expenses and management costs are incurred on your behalf, so that if for any reason our firm decides to advance them, you must reimburse them within 15 days from the presentation of the corresponding note.

Source of Funds

To comply with Law No. 155-17 against Money Laundering and Terrorism Financing, you are cautioned that you must declare and acknowledge that the funds you will provide for the execution of the contracted services are not the product of illegal activities, agreeing at the same time to supply the firm, the banking institutions or pertinent governmental authorities, any information that is requested regarding the origin of said funds, as well as their personal identity and the final beneficiary of the operation.

No Guarantee of Results or Costs

All legal representation is subject to factors beyond the lawyer’s control that can affect both the result of the management and the costs. This firm undertakes to work diligently to obtain the desired result for the expected cost, but not that it will obtain said result for that cost. When it comes to buying property, it is almost always safe to obtain the property title. If any difficulties arise from our investigation, we proceed to notify you so that you decide whether to cancel or continue.

The firm will inform you promptly about the progress of the contracted services and will consult you on any unforeseen matter that occurs, especially if it could result in the expansion of the scope of our services or in the increase in their costs, in which case no decision will be taken without your consent.

Confidentiality

Communications related to contracted services are confidential except for those provided in Law No. 155-17 against Money Laundering and Terrorism Financing. In order for this attorney-client privilege to be effective, it is recommended that you do not discuss or disclose to third parties the content of our advice or any related document.

Conflict Resolution

The terms of our contractual relationship will be interpreted according to Dominican law and, if necessary, judged by the competent courts of the Dominican Republic.
